Defense Verdict In Bed Bug Case

Partner Elizabeth Boratto obtained a not guilty verdict for her client last month following a bench trial in Marion County, Indiana. The client/defendant owned and managed an apartment complex located in Indianapolis. The plaintiff was a tenant in the building and claimed that shortly after moving into the apartment complex she suffered from bed bug bites. She claimed defendant was negligent by allowing bed bugs to infest her unit and by failing to remedy the alleged bed bug infestation. She sought both personal injury and property damage from the alleged infestation.

From day one, defendant categorically denied all of plaintiff’s allegations. In support of the defense, Ms. Boratto was able to secure favorable testimony from a Marion County Health Specialist with expertise in bed bug infestations to testify on behalf of the defendant.
